Paved With Good Intentions: Title IX Campus Sexual Assault Proceedings and the Creation of Admissible Victim Statements

46 Golden Gate U. L. Rev. 117

How is it that survivors of sexual assault on college campuses can be questioned about a felonious sex crime in the context of an extrajudicial campus disciplinary proceeding, and for those statements not to have implications for future criminal action? Couldn’t those statements be used against the complaining witness for the purpose of impeachment? My Comment addressed those questions, explored the complex social and legal web of Title IX campus sexual assault proceedings and posited solutions for improvements in the process.
